Apple and Nokia have been in a patent battle related to smartphones, but the International Trade Commission has just published a ruling for Apple.

According to BusinessWeek:

A judge with the International Trade Commission of the United States in Washington, said today that Apple does not violate the rights of Nokia Patent. The findings of the judge are subject to review by the commission of six members.

The move comes just a few months after Apple and Nokia exchanged of patent prosecution and that same Committee has also ruled that Nokia has not been infringed on patents for Apple. This does not mean that the battle between the two companies is complete, as each will continue to use its patents as weapons if it possibly can.

Nokia is still largest smartphone maker the most in the world, but he was handed his lunch by Apple and its iPhone in the past few years. While Nokia is always a greater global smartphone manufacturer, Apple is quickly closing the gap of percentage and it is already the way to go to the departments of mindshare and profits.

Partly because of the impact of the Apple iPhone, Nokia moves Windows Phone 7 for its high range and the size of the company could give him a chance.

As for Apple, it's going to continue to do what he does and always send out millions of units that each quarter and it will choose what time it takes others to the Court. The IAB decision is not final, as there still be examined by the commission before it is considered final.
